Pragmatic Approach
Simon Berry has a reputation for adopting
a facilitative team approach to major projects, working closely
with his clients and their advisors to develop pragmatic strategies
to secure the resource consents and other approvals they need.

His preferred
approach is to attempt to facilitate resolution of environmental
disputes in a manner that involves the relevant consent authorities
and recognises the interests of legitimate stakeholders while
ensuring that potential adverse effects on New Zealand’s environment
are minimised. This approach can avoid the costs, uncertainty
and delays associated with litigation before the Environment
Court and can narrow the scope of the issues in dispute should
a hearing before that Court become necessary. Simon has acted
as counsel on a number of major projects where appeals have been
lodged but substantive Environment Court hearings did not transpire
to be necessary. Recent examples include Kawerau Geothermal
Power Station, Tauranga City Wastewater System, and the Te Uku Wind Farm.
However, if hearings before the Environment Court are necessary, Simon has demonstrated
that he is more than capable of obtaining authorisations for hotly contested
projects.
