Water

Simon Berry has a particular interest in water and is the co-author (with Bal Matheson) of the chapter on “Water Law” in Environmental and Resource Management Law (3rd ed.). Other relevant experience includes:


Acting for Hamilton City Council to obtain a longer term consent for Hamilton City’s water take (recipient of RMLA, NZPI and ACENZ prizes).

Preparing submissions on behalf of the Environment Waikato group and Local Government NZ in relation to the National Policy Statement for Freshwater Management.

Assisting Hamilton City Council in relation to industrial water takes and stormwater issues.

Assisting Environment Canterbury in relation to high level strategy groundwater allocation matters.

Acting for the Waikato Regional Council in connection with Variation 5 to Waikato Regional Plan, which creates land use rules to control non-point discharges of nitrogen to Lake Taupo.

Advising Watercare and the local authorities along the Waikato River in relation to Variation 6 of the Waikato Regional Plan regarding water allocation.

Assisted Watercare to obtain many resource consents required in connection with the Auckland Water Supply System, including:

  • Waikato River Water Supply Project.
  • Special empowering legislation during Auckland Water Crisis.
  • Resource consents renewals for water supply dams in the Waitakere and Hunua Ranges.
  • Simon provided advice to the Waitaki Water Allocation Board as to the scope of the Resource Management (Waitaki Catchment) Amendment Act 2004. (Opinion on Ministry for the Environment Website).

Simon has also been involved in a number of cases involving applications for water conservation orders, including the Ahuriri River, Rakaia River and Motu River.
